Mastering Immigration Law Subscription Updates January 2020

Our first collective subscription update of 2020 brings subscribers a huge list of topical updates, highlights from the January 2020 update include:

  1. The new EUSS appeals regime, which was introduced at a day’s notice via the Immigration (Citizens’ Rights Appeals) (EU Exit) Regulations 2020
  2. EUSS criminality, in relation to which there is now a new section with a top tip on strategy in the face of policy uncertainty, as well as references to incisive reports by ILPA and Unlock
  3. Global Talent, a distinctly non Australian Points Based System style route designed to fast-track world leaders in science and research

  • 9.3.5 Challenging an age assessment: new case law added- AB v Kent County Council [2020] EWHC 109 (Admin) on margin of error in age assessments
  • 9.4 Fast-track Appeals: new case law added – MW [2019] UKUT 411 on the consideration, in later proceedings, of FTT decisions made under the detained fast-track procedures
  • Case law on fresh claims: new case law reference added – MW [2019] UKUT 411
  • 11.1 Brexit negotiations and settled status: section re-written following the UK’s exit from the EU on 31 January 2020 and the commencement of the transitional period
  • 11.6.8 EU Settled Status: update of section following the UK’s exit from the EU on 31 January 2020 and the commencement of the transitional period
  • Differences between the EEA Regs and leave under Appendix EU: updated reference to renumbered parts to Appendix EU
  • Pre-settled status: minor amendments to section
  • What is a ‘supervening event’? – Reference to 2-year absence on PSS added
  • Suitability under Appendix EU: minor amendments to section
  • EUSS applicants with criminal records: added new section, reference to ILPA and Unlock reports, new Top Tip on application strategy
  • Application procedure and guidance: added link to EUSS paper forms and resolution centre triage, new Top Tip on confronting HO gatekeeping on paper forms for Zambrano EUSS applications
  • How to challenge EU settled status refusals – appeals and administrative review: section added on EUSS appeal rights under the Immigration (Citizens’ Rights Appeals) (EU Exit) Regulations 2020
  • 13.1.9 Unlawful detention: new case law added – AC (Algeria) [2020] EWCA Civ 36 on the grace period within which SSHD must release a detainees where a case cannot be advanced within a reasonable period
  • Status appeals: new case law added – MSU Bangladesh [2019] UKUT 412 on the procedure applicable to status appeals
  • Further evidence: new case law added – Abbasi [2020] UKUT 27 on the UT’s discretion to re-open a case where post-decision evidence of fraud comes to light
  • Initial hearing: added info on email service by the UTIAC London from 3 February 2020
